In addition, CJO 20-008 modifies the UTCR and expands e-signature authority, and CJO 20-010 authorizes suspension/waiver of collection fees. Kate Brown has banned gatherings of more than 250 people within Oregon through April 8. Social distancing can reduce transmission of the virus, helping to delay and slow the spread of the COVID-19. Douglas County Circuit Court: Notice of Disapproval of SLR 4.181(d) The Trial Court Administrator for the Circuit Court for Douglas County has provided a memorandum regarding the disapproval, which was issued on December 12, 2019, through Chief Justice Order 19-109 . A Message for Attorneys Who Practice in the U.S. District Court for the District of Oregon The U.S. District Court for the District of Oregon will implement CM/ECF NextGen on January 21, 2020. Please review the NextGen Instructions about how to ensure that you will be able to e-file when NextGen is implemented. For those with a PACER account that was established in mid-2014 or before, the attorney will need to upgrade the PACER account. In addition, all users will have to make sure they know their CM/ECF username and password and keep them handy, so that they can link their PACER and CM/ECF accounts in order to e-file in Oregon federal district court on or after January 21. Essentially, the changes to CM/ECF will allow users to have a single user ID and password for both PACER and CM/ECF, and new applicants to the District of Oregon Bar will submit their applications via PACER. Otherwise, the user experience for e-filing will stay the same. Even so, it is important to review the steps in the document linked abovee to avoid any interruptions to your ability to e-file. Oregon Chief Justice Issues Rule Limiting Courthouse Arrests On the recommendation of the Uniform Trial Court Rules (UTCR) Committee, Oregon Supreme Court Chief Justice Martha Walters today enacted a rule that prohibits civil arrests in state courthouses unless the arresting agency has a judicial arrest warrant. The rule was adopted following a request to prohibit U.S. Immigration and Customs Enforcement (ICE) agents from making arrests in courthouses acting only on their own administrative warrants. The UTCR Committee reviewed a proposal to ban civil arrests without a judicial warrant both in courthouses and when people are in transit to or from court proceedings. The final rule reflects the Committee’s recommendation and prohibits non-judicial arrests only in court facilities or their vicinity (including entryways, sidewalks, and parking lots). The rule does not require judges to take any specific enforcement action, but also does not limit their ability to enforce this rule or other law. The rule will be posted for public comment in mid-December and reviewed again by the UTCR Committee in April 2020. Once posted, people wishing to comment on the rule can do so here: https://www.courts.oregon.gov/programs/utcr/committee/Pages/default.aspx. Changes to the Bar Rules of Procedure On October 16, 2019, the Supreme Court approved amendments to the Bar Rules of Procedure (BRs) that will be effective December 1, 2019. In addition to an increase in the number of Disciplinary Board members serving in Region 4 (BR 2.4), the revisions also update rules related to formal reinstatement (BR 8.1, BR 8.8 and BR 8.12). The amendments provide that applicants who are seeking formal reinstatement to the bar after engaging in misconduct must demonstrate character reformation prior to reinstatement. This showing is already required by existing case law. See In re Griffith, 323 Or 99 (1996). The amendments clarify the applicable formal reinstatement standards and related procedures. Supreme Court Order 19-084 Changes to the Bar Rules of Procedure On May 14, 2019, the Supreme Court approved amendments to the Bar Rules of Procedure (BRs) that will be effective September 1, 2019. Changes of interest include revisions that will impact all voluntary resignations (referred to as “Form A” resignations) occurring on or after December 1, 2019.
